After receiving your first Notice of Claim letter, payment is due 25 days after the first Notice of Claim was mailed to you.
If you only wish to request a reduction in the civil penalty amount, you may submit a request for the Troop S Settlement Agreement Program. This program is not to be used to dispute the validity of the violations received. Troop S will determine if your case is appropriate for a settlement and contact you with the decision regarding your request. To submit your settlement agreement request in writing, please include the following information: Commercial Vehicle Examination Report Number, Company Name, Company mailing address, DOT Number (if applicable), Your Name, Phone Number, email address, and justification for your request as well as a suggested resolution. Oklahoma Highway Patrol, Troop S NOTE: Settlement Program requests must be submitted within 25 days of receiving the 1st Notice of Claim sent by the Oklahoma Highway Patrol, Troop S Division. If the request is submitted on/after the 26th day of the specified time frame, the request will be considered UNTIMELY. A denial response will be sent in writing via email or by postal mail.
The primary purpose of a Motor Carrier Safety and Hazardous Materials Transportation Act Administrative Hearing is to allow the motor carrier company the opportunity to challenge the issuance of an administrative civil penalty associated with an Out-of-Service (OOS) violation (s) discovered during a roadside inspection.
NOTE: If you, the motor carrier, are organized as a corporation, LLC, or a partnership, you may not proceed to a hearing unless you are represented by an attorney licensed in Oklahoma. You must be represented by an attorney at the hearing and throughout every stage of the hearing and administrative process. See Massongill v. McDevitt, 1989 OK CIV APP 82; Allen v City of Chickasha, 2009 OK CIV APP 52. See generally Rowland v. Calif. Men's Colony, 506 U.S. 194, 202-03 (1993).
