President Temple called the meeting to order at 10AM. The following Board members were present: Dugger, Pickard, Temple, and Walding. Board members Parks and Phenix were absent.
Motion by Dugger second by Pickard to approve the minutes of the April 14, 2011 Board meeting. The motion passed unanimously.
Motion by Pickard second by Dugger to approve the following: Apprenticeship (original) Vivian Briones, Edmond, Bill Eisenhour FH, OKC; Jere Doerfler, Lawton, Whinery-Huddleston FS, Lawton; Rickey Hunt, Sr., OKC, Howard-Harris FS, OKC; Brian Tschirhart, Tahlequah, Reed-Culver FH, Tahlequah; Nicolas Broadnax, Choctaw, Bill Eisenhour FH, OKC; Edwin Jackson, Edmond, Temple & Sons FH, OKC; Candus Ingram, Del City, Barnes & Friederich FH, Midwest City; and Cassai Trammell, Madill, Watts FH, Madill. The motion passed unanimously.
Motion by Pickard second by Dugger to table the following: Apprenticeship (original) Andrea Engelhaupt, Edmond, Matthews Funeral & Cremation Service, Edmond (Need affidavit of employment & citizenship). The motion passed unanimously.
Motion by Pickard second by Dugger to approve the following: Apprenticeship (1st extension) Robert Combs, Cushing, Palmer Marler FH, Cushing (UCO) and Crystal Kelley, Cashion, Smith-Gallo FH, Guthrie (UCO). The motion passed unanimously.
Motion by Pickard second by Dugger to approve the following: Funeral Director/Embalmer (original) Joshua Marler, Stillwater (Funeral Director Only). The motion passed unanimously.
Motion by Pickard second by Dugger to approve the following Establishments: Ninde Funeral Directors, Woodland Chapel, Tulsa, Charles Ninde, Jr., FDIC request to close establishment; Absolute Economical Funeral Home, LLC, OKC, new establishment, Absolute Economical Funeral Home, LLC, Debra House requesting to be FDIC and Hallford Cremation & Funeral Options, LLC, Tulsa, Michael Hallford FDIC request to close establishment. The motion passed unanimously.
Motion by Dugger second by Temple to find probable cause on complaint 11-25 regarding Death Certificate Issue. The motion passed unanimously.
Jay Baines with OFDA spoke about the June 24 planning session in Miami, Oklahoma.
Bill O’Brien spoke about the resolution of the Spurlock case by way of settlement conference on April 26, 2011.
Under new business a motion by Pickard second by Temple to approve the following apprenticeship (original): Marcella Hunt - McKay Davis Funeral Home. The motion passed unanimously.
Chris Ferguson reported that the ME legislation is moving along, SB250 will be heard in committee today at 1:00pm and the next ME Board meeting will be May 24, 2011. Also staff attended a retirement party for UCO professor Gary Sokoll.
Mark Riley reported that he has recently attended investigator training in Austin, Texas and that he also attended a press release concerning the Ron Schumacher case, you can see this press release at: http://www.okfuneral.com/news/index.htm
Regarding Board complaint 09-58: Board v. Nick Reynolds Funeral Service in Tulsa and Adams Crest Cremation Service in Collinsville, Nick Reynolds, Nancy Murrell and Cassandra Lawrence: Mr. Reynolds was present and represented by James Goodwin, Mrs. Murrell was present and represented by Marty Skrapka. Mrs. Lawrence was not present and not represented by counsel. Southwest Court Reporting recorded the proceedings. Mr. Dugger was recused from the case.
After testimony from Lloyd Brown, Nick Reynolds, and Chris Ferguson a motion by Walding second by Temple to enter to executive session pursuant to 25 O.S. Supp 1998, Subsection 307 (B) (8) to engage in deliberations or rendering a final or intermediate decision in an individual proceeding pursuant to Article II of the Administrative Procedures Act regarding Nick Reynolds Funeral Service, Adams Crest Cremation Service, Nick Reynolds, Cassandra Lawrence and Nancy Murrell.
Motion by Walding second by Temple to reconvene the regular meeting. The motion passed unanimously. During the executive session only this case was discussed and no votes were taken.
Motion by Walding second by Pickard to dismiss the portion of the complaint regarding Nancy Murrell and Cassandra Lawrence, and to fine Nick Reynolds Funeral Service in Tulsa $250.00. The motion passed unanimously.
Motion by Temple second by Pickard to adjourn at 1:46PM. The motion passed unanimously.
